Welcome to joylewisauthor.com (“Site”). These Terms & Conditions (“Terms”) govern your access to and use of the Site and participation in surveys, sweepstakes, and giveaways. By accessing or using the Site, subscribing to our newsletter, or entering any survey or giveaway, you agree to be bound by these Terms (and any additional Official Rules).

1. Acceptance of Terms

If you do not agree with any part of these Terms, you must not access or use the Site or participate in surveys/giveaways.

2. Use of the Site

  • Eligibility: You must be at least 13 years old to use the Site. For sweepstakes/giveaways, eligibility criteria (such as minimum age, U.S. residence) will be specified in Official Rules for each promotion. By using the Site or entering a promotion, you warrant that you meet those requirements.

  • License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes, subject to these Terms.

  • Prohibited Conduct: You agree not to:

    • Use the Site in violation of any law or regulation.

    • Attempt to gain unauthorized access to any portion of the Site.

    • Upload or transmit viruses or malicious code.

    • Post or transmit infringing, defamatory, obscene, or otherwise objectionable content.

    • Tamper with surveys or giveaway entry processes (e.g., multiple entries in violation of Official Rules).

3. Intellectual Property

  • Content Ownership: All content on the Site (text, images, graphics, book cover art, logos) is owned or licensed by joylewisauthor.com or the author (Joy Lewis) and is protected by copyright, trademark, and other intellectual property laws.

  • Restrictions: You may view, download, and print content solely for personal, non-commercial use. Any other use, including reproduction, distribution, modification, or republication without express written permission, is prohibited.

  • User-Generated Content (Surveys): If you submit comments or creative input in surveys, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, translate, distribute, and display such content in any media for purposes related to the Site or promotions, unless otherwise stated in that survey’s notice.

  • Giveaway Entries: By submitting an entry, you grant us the right to use your name, likeness, city/state for promotional/publicity purposes if you win, as specified in Official Rules.

4. Newsletter and Communications

By subscribing to our newsletter via MailerLite, you agree to receive periodic email communications. You can unsubscribe at any time via the link in the email or by contacting joylewis@joylewisauthor.com. We reserve the right to send administrative emails related to your subscription or these Terms.

5. Surveys, Sweepstakes & Giveaways

5.1 Official Rules

  • Each survey, sweepstakes, or giveaway will have separate Official Rules posted on the Site (e.g., https://joylewisauthor.com/giveaway-rules/). Those Official Rules form part of these Terms for that activity. You must review and agree to them to participate.

5.2 Surveys

  • Participation is voluntary. We may offer incentives (e.g., entry into a giveaway) as described in the survey invitation. You represent that any information you provide is true and accurate.

  • We reserve the right to disqualify entries or respondents who provide false/misleading information or who violate these Terms.

5.3 Sweepstakes/Giveaways

  • No Purchase Necessary: Unless explicitly stated, no purchase is required to enter or win. Void where prohibited.

  • Entry Methods: Specified in Official Rules (e.g., form submission, social media action). Entries not complying with Official Rules will be disqualified.

  • Prize Details & Odds: Described in Official Rules. Odds depend on number of eligible entries.

  • Winner Selection & Notification: Described in Official Rules (e.g., random drawing). Winners must respond within a specified time or may forfeit the prize.

  • Publicity Release: By entering, you may grant us the right to use your name, likeness, and/or entry materials for promotional purposes without further compensation, unless prohibited by law.

  • Taxes & Costs: Winners are responsible for any taxes or costs associated with prize receipt or use, unless otherwise stated.

  • Disqualification: We reserve the right to disqualify entrants who tamper with the entry process or violate Official Rules or these Terms.

  • Release: By participating, you agree to release and hold harmless joylewisauthor.com, its affiliates, and their officers, directors, employees, and agents from any liability arising from participation or acceptance/use of prizes.

  • Limitations: Only one prize per person/household per promotion, unless Official Rules state otherwise.

  • Void Where Prohibited: These promotions are governed by U.S. federal, state, and local laws; void where restricted or prohibited.

6. Links to Third-Party Sites

The Site may contain links to external sites (e.g., book retailers, social media, survey platforms). These are provided for convenience. We do not endorse or assume responsibility for content, products, or services on those sites. Visiting them is at your own risk.

7. Disclaimers

  • No Warranty: The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

  • Accuracy of Information: We strive to keep content up to date, but we do not guarantee that information (e.g., survey incentives, giveaway details, release dates, pricing) is accurate or complete at all times.

8. Limitation of Liability

To the maximum extent permitted by applicable law, joylewisauthor.com, its affiliates, and their officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or participation in surveys/giveaways. Our total liability for direct damages will not exceed the greater of: (a) the amount you paid to access the Site (if any), or (b) $100 USD.

9. Indemnification

You agree to indemnify, defend, and hold harmless joylewisauthor.com and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of the Site.

  • Your participation in surveys or giveaways, including violation of Official Rules.

  • Your violation of these Terms.

  • Your violation of any rights of a third party.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms, your use of the Site, or participation in promotions shall be resolved in state or federal courts located in Tennessee. You consent to personal jurisdiction and venue in those courts.

11. Changes to Terms

We may modify these Terms at any time by publishing revised Terms on the Site. The “Effective Date” at the top will be updated. Your continued use after changes indicates acceptance. If you disagree with changes, you must stop using the Site and not participate further in promotions.

12. Termination

We may suspend or terminate your access to the Site or disqualify you from participating in any survey/giveaway at any time, without notice, for conduct we believe violates these Terms or Official Rules or is harmful to other users or us.

13. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force.

14. Entire Agreement

These Terms (together with our Privacy Policy and any Official Rules for surveys/sweepstakes/giveaways) constitute the entire agreement between you and joylewisauthor.com regarding your use of the Site and participation in promotions, superseding any prior agreements.
